Welcome to Ebadah, operated by EQ Enterprises Inc. (“Ebadah,” “we,” “us,” or “our”).

These Terms of Service (“Terms”) govern your access to and use of the Ebadah mobile application, website (ebadah.app), and related services (collectively, the “Services”). By creating an account or using Ebadah, you agree to these Terms.

If you do not agree with these Terms, please do not use Ebadah.

1. Eligibility

You must be at least 13 years old to use Ebadah. By creating an account, you represent that:

  • You are at least 13 years of age
  • The information you provide is accurate
  • You will comply with these Terms and all applicable laws

2. About Ebadah

Ebadah is a productivity and habit-building application designed to encourage intentional acts of worship by allowing users to unlock selected apps through completing acts of ibadah.

Ebadah is intended to assist users in building positive habits. It is not intended to replace religious guidance, professional advice, or qualified scholarly instruction.

3. Your Account

To use certain features, you must create an account. You are responsible for:

  • Keeping your login credentials secure
  • Maintaining accurate account information
  • All activity that occurs under your account

You agree not to share your account with others.

4. Acceptable Use

You agree that you will not:

  • Violate any laws or regulations
  • Attempt to gain unauthorized access to our systems
  • Interfere with the operation of Ebadah
  • Reverse engineer, copy, modify, or distribute any part of the app without permission
  • Use automated scripts, bots, or software to manipulate app functionality
  • Attempt to bypass app restrictions or token systems

We reserve the right to suspend or terminate accounts that violate these Terms.

5. Intellectual Property

Ebadah, including but not limited to the app, logo, branding, design, graphics, user interface, software, source code, text, features, and content, is owned by or licensed to Ebadah and is protected by applicable intellectual property laws.

Nothing in these Terms grants you ownership of any intellectual property rights. You may not copy, reproduce, modify, distribute, or commercially exploit any part of Ebadah without prior written permission.

6. User Content

You retain ownership of information you submit to Ebadah, such as account information, prayer tracking, ibadah activity, preferences, and settings.

By using the Services, you grant Ebadah permission to store and process this information solely for the purpose of providing the Services.

7. App Functionality and Permissions

Ebadah relies on certain device permissions to provide its functionality. Depending on your device, this may include Accessibility permissions, Usage Access, Screen Time permissions, Background Activity permissions, and Notification permissions (when enabled). If required permissions are disabled, certain features may not function correctly.

8. Subscriptions and Purchases

Ebadah offers a free plan and an optional Premium subscription. Premium subscriptions are billed on a recurring basis (such as monthly or annually) through Google Play or the Apple App Store and automatically renew unless canceled before the end of the current billing period.

You can manage or cancel your subscription at any time through your Google Play or Apple App Store account settings. Fees, any free trial terms, and refund requests are subject to the billing terms of the applicable app store; Ebadah does not directly process payments or refunds.

Subscription pricing and included features may change over time. We will provide reasonable notice of any pricing changes, which will not affect a subscription period you have already paid for.

9. Availability

We strive to keep Ebadah available at all times. However, we do not guarantee uninterrupted access. The Services may be temporarily unavailable due to maintenance, updates, technical issues, third-party service interruptions, or circumstances beyond our control.

10. Updates

We may add features, remove features, modify functionality, improve performance, or fix bugs, without prior notice.

11. Account Suspension or Termination

We may suspend or terminate your account if you violate these Terms, misuse the Services, your use creates security risks, or we are required to do so by law. You may stop using Ebadah at any time.

12. Account Deletion

You may delete your account directly from within the app. When your account is deleted:

  • Your account is immediately disabled
  • Your personal information and associated account data are permanently deleted within 30 days
  • Some information may temporarily remain in encrypted backups before being securely overwritten
  • Certain information may be retained where required by law or for fraud prevention, security, or regulatory compliance

13. Disclaimer

Ebadah is provided on an “as is” and “as available” basis. To the fullest extent permitted by law, we make no warranties regarding uninterrupted availability, accuracy, reliability, fitness for a particular purpose, or compatibility with every device.

14. Religious Disclaimer

Ebadah is intended to encourage positive habits and acts of worship. The app does not provide religious rulings (fatwas), legal opinions, or scholarly advice. Users should seek guidance from qualified scholars for religious questions or matters of Islamic jurisprudence. Ebadah is likewise not a source of medical advice or professional guidance of any kind.

15. Limitation of Liability

To the fullest extent permitted by applicable law, Ebadah, its owners, employees, affiliates, and partners shall not be liable for any indirect, incidental, consequential, special, or punitive damages arising from or relating to your use of, or inability to use, the Services, interruptions, loss of data, device issues, or reliance on app content.

Our total liability for any claim arising from your use of Ebadah shall not exceed the amount you paid for the Services during the twelve (12) months preceding the claim, or CAD $100, whichever is greater.

Some jurisdictions do not allow the exclusion or limitation of certain damages or warranties. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law, and nothing in these Terms limits any rights you may have as a consumer under mandatory law that cannot be excluded or limited by agreement.

16. Indemnification

You agree to defend, indemnify, and hold harmless Ebadah, its owners, employees, contractors, affiliates, and partners from any claims, damages, liabilities, losses, costs, or expenses (including reasonable legal fees) arising out of your use of the Services, your violation of these Terms, your violation of applicable law, or your infringement of another person’s rights.

17. Privacy

Your use of Ebadah is also governed by our Privacy Policy, which explains how we collect, use, and protect your information. Please review it at https://www.ebadah.app/privacy-policy.

18. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will update the “Last Updated” date and, where appropriate, provide additional notice such as an in-app notice or email. Your continued use of Ebadah after changes become effective constitutes acceptance of the updated Terms.

19. Governing Law

These Terms are governed by the laws of the Province of Alberta and the federal laws of Canada applicable therein, without regard to conflict of law principles.

This section does not deprive you of any mandatory consumer protection rights available to you under the law of your country or state of residence, where such laws apply and cannot be waived by agreement.

20. Dispute Resolution; Binding Arbitration; Class Action Waiver

Please read this section carefully. It affects your legal rights, including your right to go to court.

20.1 Agreement to Arbitrate

Except as set out in Section 20.5 below, you and Ebadah agree that any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Services will be resolved by binding, individual arbitration, rather than in court.

20.2 Arbitration Provider and Rules

Arbitration will be administered by ADR Chambers (or, if ADR Chambers is unavailable to a claimant, another comparable neutral arbitration provider reasonably designated by Ebadah), under its applicable consumer arbitration rules, seated in Alberta, Canada, and conducted in English. Where the arbitration provider’s rules conflict with this section, this section controls.

20.3 Class Action Waiver

You and Ebadah agree that each may bring claims against the other only in your or its individual capacity, and not as a plaintiff or class member in any purported class, collective, or representative proceeding. Unless both parties agree otherwise, the arbitrator may not consolidate more than one person’s claims.

20.4 Your Right to Opt Out

You may opt out of this arbitration agreement by emailing contact@ebadah.app within 30 days of first creating your Ebadah account, with the subject line “Arbitration Opt-Out” and your account email address. If you opt out, this Section 20 will not apply to you, and disputes will instead be resolved in the courts described in Section 19.

20.5 Exceptions

Notwithstanding Section 20.1, either party may bring an individual action in small claims court, and either party may seek injunctive or other equitable relief in court to prevent actual or threatened infringement, misappropriation, or violation of intellectual property rights.

20.6 If Arbitration Cannot Be Enforced

If the law of your country, state, or province does not permit enforcement of this arbitration agreement or the class action waiver in Section 20.3, then this Section 20 will not apply to you, and any dispute will instead be resolved exclusively in the courts described in Section 19, to the extent permitted by applicable law.

21. Miscellaneous

  • Severability: If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.
  • Entire agreement: These Terms, together with our Privacy Policy, constitute the entire agreement between you and Ebadah regarding the Services.
  • Assignment: We may assign these Terms in connection with a merger, acquisition, or sale of assets. You may not assign these Terms without our prior written consent.
  • Force majeure: We are not liable for any failure or delay in performance resulting from causes beyond our reasonable control.
  • No waiver: Our failure to enforce any provision of these Terms is not a waiver of our right to do so later.
  • Language: These Terms are drafted in English. Any translations are provided for convenience only, and the English version governs in the event of a conflict.
